Judge rules on three motions in Montgomery trial

CHARLOTTE – The prosecution and defense made three motions relating to opening statements Friday morning in the Demetrius Montgomery murder trial.
The judge denied the defense's first request to tell the jury about destroyed evidence by former homicide detective Arvin Fant.
In the second motion, the defense said it was not Montgomery but Octavius Elmore who shot Charlotte-Mecklenburg police officers Jeff Shelton and Sean Clark in 2007. The judge decided not to rule on the motion at this time, leaving the defense to decide if it will include its theory in opening statements.
The judge allowed the third motion, telling the state it could introduce a 911 call and radio traffic from the night of the shootings into its opening statements.
Court resumes Tuesday morning with opening statements.
